my dad steals my personal belonging?


My parents recently got a divorce and when my mom was getting all her stuff out of the house she noticed that my baby ring that my grandfather made me is missing. Also she noticed all my baby albums are missing too. I am 19 years old almost 20 and now is the time that these things where mine. I dont really know what to do because when we ask my dad he completly flips out at us. Can we take him to court to get my personal belongings back??? Please help me.

Let your dad cool off. The ring probably can't be copied. But the photos can be. Your dad can have a set and so can you. How about coming at him with this option?

Second, he may not have stolen them. If the divorce decree doesn't specify your mom gets those items or you get them, then your father gets them. He stole nothing in that case. He took possession of his personal property per the divorce decree.

Your father probably wants a set of the photos along with your mom. Why not let everyone have a set so everyone can be happy? As for the ring, maybe it can be copied too. If it can't be then maybe you can have it when he dies and you inherit it? I'd hate to see your relationship with your dad flushed away over this. It's not worth it.

Can a parent confiscate a childs personal belonging?


Okay for Christmas my dad bought me an Xbox 360 and alot of games. My mom got mad at me one day and took it and broke it. I do not live with her I live with my older sister. Is she allowed to take my stuff and break it? She has no guardianship of me anymore.

As long as you are under 18 you would be hard pressed to be able to pursue a legal avenue against your mother.

While probably not impossible, it's unlikely someone would find actual fault with a mother breaking her son's xbox.

The general rule is that parents are allowed to parent within a reasonable means.
