One of the primary duties of a police officer is to safeguard one's prisoners. If a gun is discharged while an accused is resisting, the officer is required to administer first aid and to get the prisoner to a hospital once the resistance ceases.
You are a United States Marshal. It is your sworn duty to insure that your prisoner is safe and protected. You are transporting a prisoner when someone suddenly pops out from the bushes and points a gun at your prisoner. You have enough time to shield the prisoner with your body.

I assume that there is a reason we want this person alive. For example, we gained a great deal of intel from Saddam before he was executed. I would not allow my own personal feelings that this man was scum to put the information he may know at risk.
After all, you can always execute him later (or, my favorite, throw him down a dark hole, lock him in and throw away the key), but you can't learn intel from a dead guy.

Does prohibition ever work?
I mean, murder is illegal, but people still do it in back alleys using guns and knives, right? So why not make it legal and safe, and regulated by the government. If you want to murder someone you can just take them to a murder clinic and have a professional do it, that way you don't risk harming yourself in the event the subject tries to resist.
If you outlaw murder, only outlaws will commit murder.
This is an abortion question, not a drug prohibition question. I'm all for repealing that prohibition.
People say that abortion should be legal because people will do it in back alleys anyway.
