Is a driver's license personal property?
I went out to a night club, and they wouldn't give me back my driver's license because they thought it was fake (it wasn't). It ended up turning into an hour and a half fiasco, as I had to call the police, and go home to get my passport, social security card, a huge stack of documents and bills, my credit cards, etc to prove that it was my valid driver's license. The night club claimed that they were allowed to withhold my driver's license, but I think this is BS. Does anyone in law actually know if a business can withhold personal property?
Thanks for the response. Yeah, I was thinking that even if it isn't my property, it is still property of the state of California, and this night club doesn't have the authority to unlawfully confiscate property of the state either.
No, driving is a privelege, not a right, and your driver license is owned by the state, that lets you have it as long as you comply with the laws of that state. If the driver's license it not yours, or is a counterfeit, or has been altered, you have no legal right to have it. Clubs routinely confiscate fake ID and they routinely mail them to the Police or DMV. Unfortunately, some just shred them. Some actually turn the person presenting the fake ID over to the Police for prosecution. They were wrong in your case, and that's a shame. But unlike what the other guy said, your chances of suing them and slim and none. Perhaps you changed your appearance between the time the license picture was taken and that night? There's nothing wrong with that, but that has caused problems for some folks.
