Storage and Organization of Criminal Records
Many of today’s scripted television crime dramas would have you believe that a person’s criminal record is easily obtained- stored in some mysterious vault, where they can be accessed at a moment’s notice. The reality, however, is a bit more complicated. Police stations and precincts do maintain a detailed arrest record of everyone that has been processed by them. But that’s only the beginning.
Court houses are also required to maintain records of every criminal proceeding, and carefully catalog each conviction. These court records are considered public record, and can be researched and viewed by anyone. Usually, this involves going to the actual courthouse and searching through digital files. Many of today’s better online people search tools are often a good place to start. When conducting a background search or criminal history investigation, many people start by investigating their local courts.
Courts (both county and municipal) and police stations then send a copy of all of these arrest records to their state repository. This repository contains all of the criminal history for that state. Maintaining the state criminal records repository is usually carefully monitored by a state agency. In certain states, however, sending records to the repository is done on a purely voluntary basis, making those databases much less reliable.
All of the state repository information- along with the records from police stations and courthouses across the country- is then reported to the FBI. The Federal Bureau of Investigation organizes these arrest reports at the National Crime Information Center. (NCIC) Records of all felony crimes and serious misdemeanors are stored at the NCIC. While not available to the public or for employment records, the criminal reports at the NCIC are used by law enforcement agencies across the country on a daily basis. One of the largest databases within the National Crime Information Center is known as the Interstate Identification Index. Here, the FBI maintains the fingerprint record of anyone who has been convicted of a serious crime and fingerprinted.
Another country- wide record of criminal activity can be found in the form of the National Driver Register. Updated and maintained by the Department of Transportation, the NDR is a database that contains the background information on all serious traffic offenses. These offenses may include DUI arrests, as well as violations for fleeing the scene of an accident or perjury involving a motor vehicle accident. Like the NCIC, the information contained in the National Driver Register is not available to the public. However, if a company or employer is looking to hire someone for a position that includes driving or handling a vehicle, they can check the NDR beforehand.
The careful storage, maintenance and organization of criminal records are essential for the smooth operation of law enforcement agencies.
